1. General information and identification details

In compliance with Article 10 of the Ley 34/2002, de 11 de julio, de Servicios de la Sociedad de la Información y de Comercio Electrónico (LSSI-CE) (Spanish Act on Information Society Services and Electronic Commerce), the following identification details of the owner of this website are set out below:

2. Purpose and scope of application

These General Terms and Conditions govern access to, browsing of and use of the website https://artero.com (hereinafter, the "Website"), as well as the purchase of the products offered on it.

Placing an order or browsing the Website implies the express, full and unreserved acceptance of each and every one of these terms and conditions. ARTERO reserves the right to modify these terms at any time, and the conditions in force at the exact moment the purchase is completed shall apply.

3. Distinction between consumer customers (B2C) and professional customers (B2B)

The applicable legislation differs according to the nature of the purchaser:

  • End consumer (B2C): a natural or legal person acting outside the scope of a commercial or business activity, trade or profession. They are protected by the Ley General para la Defensa de los Consumidores y Usuarios (Spanish General Act for the Protection of Consumers and Users).
  • Professional customer / distributor (B2B): a natural or legal person who purchases the products in the course of their professional, commercial or business activity (e.g. dog grooming salons, veterinary clinics). They are governed by the Spanish Commercial Code and the specific agreements set out in this document.

4. Purchase process and prices

  • Prices: all prices in the end-consumer Petcare channel are displayed in euros (€) and include the applicable Value Added Tax (VAT) in accordance with Spanish legislation. Shipping costs will be itemised before payment is completed.
  • Professional channel: prices for professionals will require account validation and will be governed by the applicable professional rates (with VAT itemised).
  • Confirmation: once payment has been completed, the customer will receive a confirmation e-mail with the details of their order within a maximum of 24 hours.

5. Shipping, delivery times and transport

  • Delivery area: ARTERO ships to mainland Spain, the Balearic Islands and the international destinations enabled in the purchase gateway.
  • Delivery times: estimated delivery times for mainland Spain are usually 24 to 72 working hours, except in the event of stock shortages or force majeure.
  • Receipt of the package:
    • B2C: the risk of loss of or damage to the goods passes to the consumer when the consumer, or a third party indicated by them, acquires physical possession of the goods.
    • B2B: professional customers have a period of 24 hours from receipt of the goods to report any breakage, impact damage or missing packages attributable to transport.

6. Right of withdrawal (applicable only to end consumers - B2C)

If you contract as a consumer, you have the right to withdraw from this contract within 14 calendar days without giving any reason.

  • Period: the withdrawal period will expire 14 calendar days from the day on which you, or a third party indicated by you, acquired physical possession of the goods.
  • Exceptions to withdrawal: pursuant to Art. 103 of the Ley de Consumidores (Spanish Consumers Act), the right of withdrawal may not be exercised in respect of:
    • Sealed goods which are not suitable for return for health protection or hygiene reasons and which have been unsealed after delivery (e.g. cosmetic products, opened shampoos, or unsealed cutting tools).
    • Goods made to the consumer's specifications or clearly personalised.
  • Cost of return: except in the event of a shipping error or defective product, the direct costs of returning the product shall be borne by the customer.
  • Procedure: to exercise the right of withdrawal, you must access our Returns Portal.

7. Warranty policy

7.1. For end consumers (B2C)

In accordance with Real Decreto-ley 7/2021 (Spanish Royal Decree-Law 7/2021), ARTERO is liable for lack of conformity that becomes apparent within three (3) years of delivery for new products.

  • Unless proven otherwise, any lack of conformity that becomes apparent within two (2) years of delivery of the product shall be presumed to have existed when the product was delivered.
  • The warranty does not cover natural wear and tear from use (e.g. dulling of scissors or blades through continuous use), impacts, misuse or improper handling.

7.2. For professional customers (B2B)

For professional purchases, the technical warranty for machinery or tools shall be governed by the manufacturer's warranty (twelve months for Artero products) or, failing that, by a period of six (6) months under the Spanish Commercial Code for hidden defects, with the professional purchaser bearing the technical shipping costs if so determined contractually. Within the warranty period we bear the cost of carriage, provided that it is a defect; if, on the contrary, you have to pay for the repair, we also include the cost of inbound and return carriage if it does not exceed €30 plus VAT.

8. Intellectual and industrial property

The Website, including but not limited to its programming, editing, compilation, designs, logos, text and/or graphics, is the property of ARTERO or ARTERO holds a licence or express authorisation from the authors. "ARTERO" is a registered trademark. The total or partial reproduction, use, exploitation, distribution and commercialisation of the contents without the prior written authorisation of ARTERO is expressly prohibited.

9. Protection of personal data

The processing of personal data collected during browsing and the purchase process is strictly governed by the provisions of our Privacy Policy, in accordance with Regulation (EU) 2016/679 (GDPR) and the Ley Orgánica 3/2018 (LOPDGDD) (Spanish Organic Act on Data Protection and Guarantee of Digital Rights).

10. Online dispute resolution (mandatory in the EU)

In accordance with Article 14(1) of Regulation (EU) 524/2013, the European Commission provides an online dispute resolution platform for consumers. If you have had a problem with an online purchase, you may use this means to attempt to reach an out-of-court settlement through the European Union's Online Dispute Resolution Platform.

11. Applicable law and jurisdiction

These terms and conditions shall be governed by and construed in accordance with Spanish law.

  • In the case of consumers (B2C): any dispute shall be submitted to the Courts and Tribunals of the consumer's place of residence.
  • In the case of professionals (B2B): both parties expressly waive any other jurisdiction to which they may be entitled and voluntarily submit to the jurisdiction of the Courts and Tribunals of Mataró / Barcelona (Spain).
